These Terms of Service ("Terms") govern your use of captivecoachingandempowerment.com and our services, including coaching, courses, workshops, the membership, and the client portal (the "Services"), offered by Captive Coaching & Empowerment LLC ("Captive Coaching," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old and able to enter into a binding agreement to use the Services.
Captive Coaching provides personal-development and performance coaching. Our Services, including the APACHE Framework™, are not therapy, counseling, medical or mental-health treatment, diagnosis, or crisis support, and are not a substitute for care from a licensed professional. Coaching does not create a doctor-patient, therapist-client, or similar relationship. You are responsible for your own decisions and actions. If you are experiencing a medical or mental-health emergency, contact a licensed professional or emergency services immediately.
Some Services require an account. You are responsible for keeping your login details secure and for activity under your account. Please give us accurate information and keep it up to date.
Fees for courses, workshops and other purchases are described at checkout. Individual coaching, digital data and workshops are non-refundable once access has been granted or digital material has been provided. Online course costs are refundable based on the refund policy for the individual course, provided at the time of purchase of access.
You keep ownership of the information and responses you submit, such as workbook entries and messages. You grant us permission to store and use that content only as needed to provide the Services to you.
All materials we provide, including course content, workbooks, videos, frameworks, text, and designs, are owned by Captive Coaching or our licensors and are protected by intellectual-property laws. You may use them for your own personal, non-commercial use as part of the Services. You may not copy, share, resell, or redistribute them without our written permission.
The Services rely on and link to third parties such as Stripe, Mailchimp, Supabase, Vimeo, and Embody Her. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
The Services are provided "as is" and "as available." We do not guarantee any specific result or outcome from coaching, courses, workshops or the membership. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
To the fullest extent permitted by law, Captive Coaching and its owners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the twelve months before the claim.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. When we do, we will change the effective date above and post the updated version on this page. Continuing to use the Services means you accept the updated Terms.
